At the signature of the provisional sales agreement, the buyer pays a deposit of a maximum amount of 10% of the price of the acquisition. This deposit is collected at the latest the last day of the cooling-off period on the escrow account of the solicitor.

Much information must appear in the provisional sales agreement:

The provisional sales agreement, also called "synallagmatic promise of private sale" commits definitively both signatories.

It amounts to a sale which will be concluded during the writing of an authentic act in the office of a notary, the time when is raised certain number of conditions:

 

· A right of retraction or reflection

Within the framework of the law SRU, a right of retraction or reflection, as the act was privately established or in front of the solicitor, exists for every type of new or old housing.

If the precontract is privately established, you have a cooling-off period of 7 days as from the next day of the first presentation of the registered letter notifying you the precontract or of its delivery by every possible means offering equivalent guarantees. Your retraction has to be made according to the same modalities (registered letter with recorded delivery, bailiff's fold). This constitutes the cooling-off period.

· The right of preemption of the city

Right which any municipality inclines to acquire by priority to the buyer a property. You buy only under the condition that the planning certificate contains nothing which can depreciate your accommodation or prevent you from taking up it.

· The obtaining of the financing of the buyer

In case the buyer signs a bank loan. The condition precedent is valid at least one month as from the date of signature of the compromise. If the buyer does not obtain an offer of loan for the deadline registered, any sum paid beforehand will have to be you at once and entirely paid off to respect all the modalities.

Act authentic signature in the office of a notary

When all the conditions are gathered 2 in 3 months after the signature of the provisional sales agreement, we go to the office of a notary to sign the authentic act.

And you are not any more the owner. Keys, code of entrance, will be given to the new owner.
