Two simultaneous actions are then going to validate your choice and to stop the marketing of the wished immovable property:

1-The signature of the provisional sales agreement (called also synallagmatic promise of private sale or precontract).

Much information has to appear on this precontract:

· The complete and exact registry office(civil status) of the salesman and the buyer

· The address of the property, its exact and precise description of the accommodation and its dependences and its surface (according to the Law Square if it is about an apartment or about the property in co-ownership)

· The origin of the property: date of the previous bill of sale, the name of the previous owner, the study of the solicitor which authenticated the act

· Concerning information diagnostic technical:

o Certificate of surface according to the law Square (for apartments in residence)

o Report of location of the asbestos privative parts

o Diagnosis of energy performance (DPE)

o Diagnosis electricity (since January 1st, 2009)

o State of the natural and technological risks (ERNT)

o Report of the risks of exposure in the lead (for the dating constructions of before 1948)

o State of the installations of gas

· The obtaining of the financing of the buyer

In case the buyer subscribes to a bank loan. The condition precedent is valid at least one month as from the date of signature of the compromise. If the buyer does not obtain an offer of loans for the deadline registered, any sum paid before hand will have to be you at once and entirely paid off.

The time of the solicitor

The provisional sales agreement, also called " synallagmatic promise of private sale ", corresponds to a precontract of property which commits definitively both signatories.
