The various stages of a successful real-estate deal:

You decided to buy, two simultaneous actions are then going to validate your choice and to stop the marketing of the wished immovable property:

1-The signature of the compromise of sale (called also synallagmatic promise of private sale or preliminary contract).

2-The payment by the buyer of a deposit of a maximum amount of 10 % of the total price of it.

The sums paid during the signature of the compromise of sale:

At the signature of the compromise of sale, the buyer pays deposit, at the level of 10 % of the price of the acquisition. This deposit is taken at least the last day of the delay of retraction on an account holds either of the real estate agency, or of the Notary.

However, if the buyer does not obtain one or several wanted loans or if one of the suspensive conditions registered in the preliminary contract plays, the compromise of sale is cancelled. The sums paid by the buyer are then necessarily paid off to him.

The compromise of sale, also called "synallagmatic promise of private sale", corresponds to a preliminary contract of immovable property which engages definitively both signatories.

The amounts to a sale which will be concluded during the editorial staff of an authentic act at the Notary, the time when is raised certain number of conditions such as for example the obtaining of a loan.

Indeed, the necessity of the compromise of sale justifies itself by the fact that it contains cancellations or suspensive implying delays. These are mainly:
  • Law of retraction or reflection.
    Within the framework of the law SRU, a law of retraction or reflection, as the act was privately established or in front of the notary, exists for any type of new or former accommodations.

    If the preliminary contract is privately established, you have a delay of retraction of 7 days as from the next day of the first presentation of the registered letter notifying you the preliminary contract or of its discount by every possible means offering equivalent guarantees. Your retraction has to be made according to the same modalities (registered letter with signed receipt, bailiff's fold). This establishes the delay of retraction.

  • The right of preemption of the city.
    Right which any municipality inclines to acquire by priority to the buyer an immovable property. You buy only under the condition that the certificate of town planning contains nothing which can underestimate your accommodation or prevent you from taking up it.

  • The obtaining of the financing of the buyer,
    in case the buyer subscribes to a banking loan. The suspensive condition is valid at least one month as from the date of signature of the compromise. If the buyer does not obtain an offer of loans for the delay registered, any sum paid beforehand will have to be you at once and in its entirety paid off.
